Fix Your Traffic Ticket?
I am regularly asked by potential clients if I can “fix” their ticket or how to go about “fixing a ticket.” There is usually nothing wrong with the ticket itself, and so the traffic ticket does not need to be fixed. What clients are typically asking for when they inquire about fixing their ticket is whether as a traffic ticket lawyer I can make the ticket just “go away.” I do not fix tickets. I cannot legally fix your traffic ticket. No lawyer should “fix” tickets. I resolve, settle or fight traffic tickets.
The truth of the matter is that fixing a ticket is illegal. Fixing a ticket suggests the lawyer is pulling strings behind the scenes with law enforcement officers, court staff, traffic ticket prosecutors or traffic court judges. All of these approaches to resolving a ticket are illegal. Therefore, a lawyer who suggests he can fix your traffic ticket acts unethically. If the traffic ticket lawyer is actually “fixing” tickets both the attorney and the person helping the lawyer are breaking the law.
With the slow economy, I have observed a number of lawyers entering the traffic ticket resolution arena, but some improperly advertise their services as ticket fixing. Any web site that purports to fix tickets is in direct violation of the Texas Disciplinary Rules of Professional Conduct and the American Bar Association’s Model Rules of Professional Conduct. I have heard potential clients indicate one particular traffic ticket lawyer in the San Antonio area assures clients they need only pay his fee and he will “fix” the ticket and guarantees it will go away. The client hears nothing more about it. I believe this attorney is simply having the client placed on deferred adjudication for a few months and not updating the client as to his/her deferred status. This process may seem like a ticket “fix,” but both the assertion of fixing the ticket and failing to notify the client of his/her deferred adjudication status is unethical. In short, you should not ask any lawyer to fix your traffic ticket.
